Federal Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous deportation to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face human smuggling allegations, he was held in federal custody.
In her order, the judge noted that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Case
The legal challenge center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.

The court, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
